Laws were originally enacted in 1921-23. The provision promotes real estate sales, continuity of investment, savings & estate planning by encouraging the exchanging of investment real estate and business properties in a way that would be free from the taxes which are due when property is otherwise sold.
If you are planning to sell rental property or other real estate held for investment and acquire other real estate to be held for investment and you can:
  1. Utilize a Qualified Intermediary to receive and hold the money from the sale of your property; and
  2. Within 45 days identify up to as many as three properties which you may wish to acquire or in reverse exchanges you may wish to relinquish; and
  3. Complete your transactions within 180 days;
